Civil Law pertains to private relations between members of the community and the private rights of citizens. Our practice pertains to the following, among others.
The Indian Contract Act, 1872
The Act came into force on April 25th, 1972. It prescribes the law relating to contracts in India and is the key act regulating Indian contract law and is based on the principles of English Common Law. The Act determines the circumstances in which promises made by the parties to a contract shall be legally binding. (Act available in PDF here)
The Partnership Act, 1932
The Act came into force on October 1, 1932. The partnership is an agreement in which two or more person has decided to carry out business and share the profit and losses equally. To create a legal relationship, it is necessary to form a partnership agreement. The partnership agreement becomes the foundation or the basis on which it is based. It can be either written or oral. The Act aims to regulate the partnerships created in India. (Act available in PDF here)
The Sale of Goods Act, 1930
The Act came into force on March 15th, 1930 and is applicable all over India. It provides for the setting up of contracts where the seller transfers or agrees to transfer the title (ownership) in the goods to the buyer for consideration. (Act available in PDF here)
The Specific Relief Act, 1963
The Act came into force on March 1st, 1964. The Act is guided by the established principles of Common Law that view damages as the presumptive remedy and specific performance as an alternate. The Act seek to protect civil and contractual rights in the event of breach of contract. (Act available in PDF here)
The Code of Civil Procedure, 1908
The Code came into force on March 1st, 1908. It consolidates and amend the laws relating to the procedure of the Civil Courts in India. (Act available in PDF here)
The Arbitration And Conciliation Act, 1996
The Act came into force on August 22nd, 1996. The Act consolidates and amends the laws relating to domestic arbitrations, international commercial arbitrations and enforcement of foreign arbitral awards. It further provides for the laws relating to conciliation of matters and for matters incidental thereto. (Act available in PDF here)
The Indian Evidence Act, 1872
The Act came into force on March 15th, 1872. The Act provides the system of rules for ascertaining the question of facts in a particular case. It consolidates the Law of Evidence in India. (Act available in PDF here)
The Bankers Book Evidence Act,1891
The Act came into force on October 1st, 1891. The Act provides for guidelines to banking institutions about legal proceedings relating to banking records. It was brought into force to amend the Law of Evidence with respect to banking records. (Act available in PDF here)
The Contempt Of Courts Act, 1971
The Act came into force on December 24th, 1971. It defines and limit the powers of certain courts in punishing contempt of courts and to regulate their procedure in relation thereto. (Act available in PDF here)
The Negotiable Instruments Act, 1881
The Act came into force on December 9th, 1881. It provides for laws relating to Promissory Notes, Bills of Exchange and Cheques. (Act available in PDF here)
